Terms of Service

1. Acceptance of Terms
By accessing sparkshop.co.za, requesting a trial, or using the SparkShop platform in any way, you agree to be bound by these Terms of Service. If you do not agree, please do not use SparkShop.
2. Who Can Use SparkShop
SparkShop is a business tool for automotive workshops. You must be an authorised representative of a registered workshop or automotive business to create an account or start a trial. You are responsible for the accuracy of the business information you provide and for keeping your account credentials secure — SparkShop is not liable for loss or damage arising from your failure to do so.
3. Trials
New accounts start as a free trial using your own workshop's real data (not sample or demo data). Trial length, the one-time extension, lockout behaviour, and data retention on an unconverted trial are governed by SparkShop's published trial terms, which may be updated from time to time — see your trial account for the current countdown and terms shown at signup. Attempting to obtain more than one trial period per business (for example, by registering trial accounts under different email addresses) is not permitted.
4. The Service Agreement
These Terms of Service govern your use of the public SparkShop website and your trial. They are not the contract that governs a paid subscription. When you go live — by signing or by making payment via a SparkShop payment link — you separately agree to the SparkShop Service Agreement, which governs billing, the annual price escalation, cancellation, and data ownership as a paying client. Where these Terms and the Service Agreement address the same topic for a paying client, the Service Agreement takes precedence.
5. Email Communications
By creating an account, you agree to receive transactional emails from SparkShop — including trial status updates, invoices, renewal notices, and account security notifications. These are essential to the security and functioning of your account and cannot be opted out of while your account is active. Marketing communications, if any, are separate and can be unsubscribed from independently.
6. Acceptable Use
You may not: use SparkShop for any unlawful purpose; attempt to reverse engineer, decompile, or extract SparkShop's source code; resell or sublicense access to SparkShop without prior written consent; or attempt to circumvent trial, extension, or billing limits described in these Terms or the Service Agreement.
7. Data Deletion & Account Termination
If your trial ends without converting to a paid subscription, your workshop's data is genuinely deleted from SparkShop's systems on the schedule described at trial signup. If you convert to a paid subscription and later cancel, your data is retained for a further period after cancellation as described in your Service Agreement, after which it is deleted. You may request deletion of your account and data at any time by contacting support@sparkshop.co.za.
8. Governing Law
These Terms are governed by the laws of South Africa.
